SHOPPING POLICY
INTRODUCTION & CONTACT INFORMATION
- This Shopping Policy applies when, through the Website or the App, you instruct Company to purchase from third-party retailers (“Retailers”) the fashion items, such as clothes & accessories (“Products”), which constitutes a “Shopping Service”, as defined in Terms of Service. To get more information on how Company processes your personal data in relation to the Shopping Service, please refer to Privacy Policy.
- The Shopping Policy is subject to Terms of Service, and the capitalized terms used but not defined herein shall have the meaning assigned to them in the Terms of Service. Except as otherwise stated herein, this Policy along with the Terms of Service constitutes the entire agreement between you and us regarding the Shopping Service, and supersedes and replaces any and all prior oral or written agreements between you and us relating thereto. If there is any conflict between the Terms of Service and the Shopping Policy with respect to the Shopping Service, the latter shall prevail.
- BY CONSENTING TO THE PURCHASE AND DELIVERY OF PRODUCTS, YOU ACKNOWLEDGE THAT YOU HAVE READ AND THAT YOU AGREE TO BE BOUND BY THESE SHOPPING POLICY AND RETAILERS’ TERMS (AS DESCRIBED IN SECTION 2). IF YOU DO NOT AGREE TO THIS POLICY, OR IF YOU ARE NOT ELIGIBLE OR AUTHORIZED TO BE BOUND BY THIS POLICY, DO NOT USE SHOPPING SERVICE IN ANY MANNER WHATSOEVER.
- We reserve the right, in our sole discretion, to make changes or modifications to the Shopping Policy at any time in case of changes to the Shopping Service, payment model or regulatory framework. We will give you notice about such changes by updating the "Last updated" date or in another practicable way, and you waive any right to receive specific notice for each change.

PLACING ORDERS / LINKING TO RETAILERS’ WEBSITES
- The App and/or the Website may offer various ways of purchasing the Product, in particular (i) the Shopping Service, and (ii) providing links to Retailers’ websites, where you can purchase Products independently.
- Your purchase agreement for any Products is solely between you and the respective Retailer, regardless of whether you initiated the transaction through our Shopping Service or by following links on our Website/App. When you initiate the transaction through our Shopping Service, it is important that you understand you are not purchasing the Products from us. Under no circumstances shall our Сompany be considered a party to such purchase agreements or transactions.
- We explicitly disclaim any and all liability, obligations or responsibilities relating to these third-party purchase transactions. This includes, but is not limited to, the product listings, pricing, availability, ordering process, order fulfillment, shipping, returns, refunds, exchanges, warranties, guarantees, and any customer service matters pertaining to the Products purchased from Retailers.
- While we strive to provide a convenient Shopping Service, we are not involved in, nor do we have any control over, the actual sales conducted between you and the Retailers. Any support services that we may opt to provide in relation to delivery or returns shall be at our sole discretion and do not establish any obligations on our part.
- By using our Shopping Service or taking advantage of Retailer product links, you expressly agree that we shall not be held responsible for any claims, damages or liabilities arising from your transactions with these Retailers.
YOU NEED TO THOROUGHLY REVIEW RETAILERS’ TERMS BEFORE CONSENTING TO THE PURCHASE AND DELIVERY OF PRODUCTS. For additional details regarding the relevant Retailers and their documentation, please refer to the information available on the websites of such Retailers.
Shopping Service
- This option enables you to arrange the purchase and delivery of the Products from Retailers by choosing the Products in the App/Website, paying the applicable fees for the Products and their delivery, and entering your contact information and address to organize such delivery. When you submit contact information and address, you grant us the right to provide it to Retailers as described in Privacy Policy.
- By choosing Shopping Service option, you hereby appoint Company as your agent to do the following on your behalf: (i) place your order on the relevant Retailers’ websites with your contact information and address, and (ii) pay the applicable price for the Products and their delivery. Once all steps are completed, you will receive an email or other form of communication from the relevant Retailer confirming the acceptance of your order of the Products. We may, at our sole discretion, assist you in communication with the Retailers regarding the return or exchange of Products purchased through the Shopping Service, but we are under no obligation to do so.
- When you place an order for Products through our Shopping Service, you will make the payment to us. We will use the funds received from you to complete the purchase on the Retailer's website. The entire amount paid by you will be utilized to facilitate the purchase of the Products from the Retailer.
Notwithstanding the foregoing, Company may in its sole discretion: (i) refuse or cancel your order, (ii) limit its quantity, or (iii) require additional information prior to accepting your order. Your order in the App/Website shall be deemed accepted only after you receive an email or other form of communication from us confirming acceptance of your order by Relevant retailer (“Order Confirmation Notice”).
Providing links to Retailers’ websites
- This option allows you to follow a link to Retailers’ websites, where you can (i) find the Product proposed by fashion stylists in the App/Website and (ii) purchase them on your own. Your further transactions and other dealings with the Retailers, including payment and delivery of the Products, are solely between you and such Retailer, and are governed exclusively by the terms of service and other applicable documentation of the relevant Retailer.
- WE DO NOT REVIEW, APPROVE, MONITOR, ENDORSE, WARRANT, OR MAKE ANY REPRESENTATIONS WITH RESPECT TO THE PRODUCTS ORDERED THROUGH THIS OPTION AS WELL AS YOUR TRANSACTIONS AND OTHER DEALINGS WITH THE RETAILERS.
PRICING, AVAILABILITY & QUALITY OF PRODUCTS
Products’ Pricing
- When the App/Website proposes you to order the Products through the Service, the mentioned price for the Product may be accurate only at the time of our proposal. Company does not control the price for the Products, and the Retailers may change them at any time without our approval or knowledge.
- If you placed an order for the Product through the App/Website and the price of Products changed before you received Order Confirmation Notice, we will contact you via email or via the App/Website for further details.
- Please note that the price for Products do not include any import duties, tariffs, taxes and similar fees that may be imposed by the delivery destination.
Availability of Products
- When the App/Website proposes you to order the Products through the Service, they may be available only at the time of our proposal.
- Please note that the further availability of the Products is solely dependent on Retailers. Company makes no representations as to the completeness, accuracy, reliability, validity or timeliness of our proposals to order the Products.
If you placed an order for the Product through the App/Website and the Product became unavailable before you received Order Confirmation Notice, we will contact you via email or via the App/Website for further details.
Quality of Products
- AS THE COMPANY IS NOT THE MANUFACTURER, RETAILER OR RESELLER OF THE PRODUCTS, WE MAKE NO EXPRESS OR IMPLIED WARRANTY AS TO THE CONDITION OF THE PRODUCTS, INCLUDING WITHOUT LIMITATION, THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE PRODUCTS, OR THAT THE PRODUCTS WILL ACCOMPLISH THE INTENDED RESULTS OR ARE SAFE FOR ANY PURPOSE INCLUDING THE INTENDED PURPOSE, OR THAT ANY OF THE ABOVE WILL NOT INTERFERE WITH PRIVATELY- OWNED RIGHTS OF OTHERS.
- We attempt to be as accurate as possible in the description of the Products displayed on the Website/App. However, as the descriptions are based on information publicly available on the Retailers’ website (who remain responsible for them), we cannot guarantee that all details are always accurate, complete, or error-free. The images of the products on the Website/App are for illustrative purposes only, and although we attempt to display colours accurately, we cannot guarantee that your device’s display of the images accurately reflects the true colour of the Products.
- For more details regarding the existence of any third-party warranty in relation to the Products and your remedies under applicable law, please refer to terms of service and other applicable documentation from relevant Retailers.
SHIPPING OPTIONS & INFORMATION. SHIPPING COSTS
- Company will use its reasonable efforts to order the delivery within reasonable time, but we shall not be responsible for any delays in delivery or differences with our estimated delivery time caused by third-party service providers.
- You shall also provide the correct contact information for shipping. The Company is not responsible for the Products that are not received due to inaccurate shipping information.
Refund, Return & Exchanges
- You may request to modify or cancel your order by contacting delivery.info@lumi-app.co immediately after placing the order. We will make reasonable efforts to accommodate your request, but we cannot guarantee that modifications or cancellations will be possible. Once you received the Order Confirmation Notice, any modifications or cancellations will be subject to the Retailer's terms and conditions, over which we have no control. The Retailer(s) reserve the right to refuse or impose fees for order changes or cancellations, in accordance with their policies.
- Once you placed an order through the App/Website, you may ask to refund the fees for the Products at any time via email or the App/Website before receipt of the Order Confirmation Notice. The estimated refund time shall be 14 (fourteen) days after receiving your request for refund.
- After receipt by you of the Order Confirmation Notice, the return, refund and exchange policies of Retailer(s) shall apply. In this case, we are not responsible for refund of payments, return or exchange of the Products.
- Notwithstanding the foregoing, if the Retailer(s) agrees to refund the price for the Product to us, we will transfer the fees for the Product back to you. The estimated refund time shall be 14 (fourteen) days after the Retailer(s) refunded the fees for the Products to us.
- Please note that, under terms of service or other applicable documentation of Retailers, shipping and handling charges, wrap fees, and taxes paid (such as state, sales tax, customs or value added tax) may be not refundable. Also, the restocking fee may be deducted by Retailers.
- We reserve the right, at our sole discretion, to assist you in communicating with Retailer(s) regarding refunds, returns, or exchanges of Products, subject to the following conditions:
- You must contact us within 5 days of the Product delivery date to request such assistance.
- You must provide all relevant documentation and information from the Retailer, including proof of purchase, return policies, and any other pertinent details.
- The Product(s) must be in their original, undamaged condition, with all packaging and accessories intact.
- Our assistance will be limited solely to facilitating communication between you and the Retailer. We will not be responsible for any shipping, packing, handling, or other logistical aspects related to the return or exchange process. Additionally, we do not guarantee the successful resolution of any refund, return, or exchange request, as the final decision rests with the Retailer's policies and procedures.
- By requesting our assistance, you acknowledge and agree that our role is limited to communication facilitation only, and we shall not be held liable for any damages, losses, or inconveniences arising from the Retailer's actions or decisions regarding your request.
- COMPANY DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES WITH RESPECT TO RETAILERS REFUND POLICIES AND/OR COMPLIANCE OF RETAILERS WITH MANDATORY RIGHTS OF WITHDRAWAL IN CERTAIN COUNTRIES OR THEIR OWN POLICIES. WE SHALL NOT BE RESPONSIBLE FOR ANY DAMAGES CAUSED BY RETAILERS NOT COMPLYING WITH MANDATORY RIGHTS OF WITHDRAWAL IN CERTAIN COUNTRIES OR THEIR OWN POLICIES.
Force Majeure
- The purchase and delivery of the Products can be affected by third parties and/or conditions beyond our reasonable control, including without limitation, acts of God, catastrophes, government restrictions, wars, acts of terrorism, insurrections, strikes, fires, floods, special events cancellation, failure of equipment or transmission difficulties or work stoppages (collectively, “Force Majeure Events”).
- In case of Force Majeure Events, we shall not be liable for any damages, delay or non-performance of obligations under this Shopping Policy. Company will use its reasonable efforts to avoid the effect of Force Majeure Events and continue performing the obligations once the relevant Force Majeure Event ends.
- Please note that the relevant Retailers may have their own policies regarding Force Majeure Events, which we do not control and are not responsible for.
